ClavCast is an entertainment application that uses artificial intelligence to generate a humorous, exaggerated "persona" based on your public social profiles (e.g., X, Bluesky, Threads). The Service is intended for entertainment, self-expression, and personal amusement purposes only.

No Professional Reliance: The generated personas are satirical and fictionalized. You should not rely on them for professional, medical, legal, or financial advice or decisions.

3. Eligibility

You must be at least 18 years old to use the Service. By agreeing to these Terms, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into a binding contract.

4. Account and Access

Social Login: Access to the Service requires logging in via your connected social accounts (e.g., X, Bluesky, Threads) using standard authentication protocols like OAuth.
Revocation: You may revoke our access to your accounts at any time via your respective platform settings, though revoking access from all your connected platforms will prevent further use of the Service.
Termination: We reserve the right to suspend or terminate your access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

5. User Responsibilities

You agree not to use the Service to:

Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or hateful.
Reverse engineer, decompile, or attempt to extract the source code of the Service.
Scrape or automatically collect data from the Service without our prior written consent.
Violate the terms of service of X or our third-party LLM providers.

6. Intellectual Property

Our Content: The Service, including its "ClavCast" branding, improved algorithms, and underlying code, is our intellectual property.

Generated Content: You retain ownership of your profile data. We grant you a non-exclusive, worldwide, royalty-free license to use, share, and display the generated persona descriptions for your personal, non-commercial use. You acknowledge that due to the nature of AI, improved outputs may not be unique and other users may receive similar content.

7. Disclaimers

"AS IS" Basis: The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

AI Disclaimer: The Service uses large language models (LLMs) which may produce inaccurate, offensive, or nonsensical outputs ("hallucinations"). We do not guarantee the accuracy or appropriateness of any generated content.

8. Limitation of Liability

To the maximum extent permitted by law, ClavCast shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Service; (b) any conduct or content of any third party on the Service; or (c) unauthorized access, use, or alteration of your transmissions or content.

9. Third-Party Services

The Service relies on third-party platforms, including X (Twitter), Bluesky, Meta (Threads), and OpenAI (or other LLM providers). We are not responsible for the availability or performance of these third-party services. Changes to their APIs or terms may affect the functionality of our Service.

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.

11. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by updating the date at the top of these Terms and, where appropriate, providing notice through the Service. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
